Terms and Conditions of Website and eLearning Use
Of OBA School Ltd

Definitions of Terminology Used in this Terms and Conditions Agreement:
‘OBA’, ‘OBA School’, or the pronouns ‘us’, ‘we’ or ‘our’ refer to OBA School Ltd., while, our ‘website’, ‘eLearning’, ‘VLE, ‘LMS’, ‘platforms’, ‘Portal’, ‘online platforms’ or ‘eLearning platform’ all refer to OBA School website and/or online platform where our learning materials and courses are delivered at www.obaschool.co.uk or at https://vle.obaschool.com
The pronoun ‘you’ or the noun ‘student’, ‘user’ or ‘private candidate’ refer to the applicant identified as the participant associated with the course/s in the application to access our online course/s offered through our eLearning or, if the participant is under 18 years old, the parent or guardian submitting the Registration Application.
‘Course’ or ‘courses’ refer to the programme or programmes of study you have chosen to enrol on, and include learning materials, support and tuition as specified on our site.
‘Internal exams’ refer to the exams that students take online at the OBA School throughout the course which do not count towards their formal exams or qualifications.
‘External exams’ refer to the formal exams that students sit for at the approved exam centres, where marks achieved count towards formal qualifications.
‘Conditions of Enrolment’, ‘Terms and Conditions of enrolment’, ‘Terms’, ‘Contract’, ‘Conditions’ refer to the terms and conditions content stated in this agreement.
‘Registration Form’, ‘Enrolment Form’, ‘Registration Application’, ‘Application’ refer to the same document.
‘Study Materials’ or ‘Course Materials’ refer to the materials that OBA School will make temporarily available for you to use during the length of your enrolment.
‘Digital Service’ refers to the service you will receive electronically over the internet by OBA School including the electronic tutorials and course materials, emails, support over the internet or over the phones and any service that we provide over the internet.
‘Subscriptions’ and ‘enrolment’ refer to your commitment to study a course or courses with us for a finite period of time. We pledge to provide you with the online tutoring required to study the course for the period of the subscriptions.
For all terms stated above, the meaning of any of the terms refer to the same term regardless whether it is written in capitals or not, and whether it is in plural or singular in form.
About These Terms and Conditions
Terms and Conditions of enrolment apply to any contract between you and OBA School in respect of your participation on any of our course/s which we deliver 100% electronically online through our eLearning platform. Please read our Terms and Conditions of enrolment carefully before agreeing on it.
Please note that before receiving your access credentials for the course/s you applied for, you will need firstly to accept our Terms and Conditions agreement. By agreeing to our terms and conditions you become bound to its content. If you do not want to accept the Terms and Conditions, you will not be able to access the courses offered by OBA School.
About OBA School and Your Contract

Unless the Terms and Conditions state otherwise, you are entering into a legally binding contract with OBA School, which is incorporated in England and Wales under number 07819979. Its registered office is at 13 Hubert Walter Drive, Maidstone, Kent, ME16 0BE, UK.

The contract you enter into on these Terms and Conditions is personal to you. You cannot assign or transfer any or all of your rights or obligations under these Terms and Conditions of enrolment without the prior written consent from OBA School.

OBA School may assign or transfer the contract in whole or in part, or subcontract or delegate the delivery of the courses in any manner at its sole discretion to any separate entity, any provider, or outsource it to third-party services.
Intelectual Property
The copyright and all other intellectual property rights in all OBA School course materials shall remain the sole and exclusive property of OBA School and its licensors. You will not copy or permit copying OBA School materials or distribute any of these materials via internet or intranet or disclose or permit the disclosure or sell or hire the same to third parties.
OBA School is the owner or the licence of all intellectual property rights in the digital service and in the design, structure, ‘look and feel’ and the arrangement of the Digital Service.
OBA School agrees to grant to you a non-exclusive free licence to use the relevant OBA School materials for the purposes of your study in relation to the course/s you are enrolled in, but not for commercial purposes.
Website Terms of Use
All of the study materials provided by OBA School during the courses are the property of OBA School and its licensors and subscribing students does not mean any of the materials ownership has been transferred by OBA School to the student.
Our awarded scholarships courses are designed for viewing within the United Kingdom. Any access outside of the United Kingdom is at the student’s own risk such as but not limited to underperformance or IP restrictions.
Access to and use this site is provided by the OBA School subject to the following terms:

Your subscription is limited to you as the person awarded the scholarship. Violating this condition leads to immediate termination of the subscription/s. By this agreement you would explicitly agree to accept the security and integrity IP check we run frequently through our eLearning platform to determine if dual log in occurs for the same account from two different devices concurrently.
You as a user agree to be legally bound by following terms, which will take effect immediately on your first access to our eLearning Platform.

You will not copy, reproduce, republish or otherwise the content from this site in any way except the PDF files that are made available to you for your personal use.

You agree to use our eLearning only for educational purposes, politely, ethically and with no act that includes prohibited behaviour. By prohibited behaviour we mean harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content. You agree that your access to our courses will be immediately terminated if you upload or display any comments or materials through your participation to our eLearning platform or by email which are false, offensive, sexually explicit, defamatory, threatening, obscene or unlawful.

Under no circumstances OBA School will be liable for users loss of data or opportunity.

OBA School does not warrant that the site functions and content will be uninterrupted or error free, that defects will be corrected, or that the servers are permanently viruses, Trojans or other harmful mechanisms free. It is strongly recommended you install a reliable antivirus application or software to protect your computer efficiently.

If your use of our eLearning platform results in the need for servicing or replacing your equipment, OBA School will not be responsible for the costs incurred.

You understand that OBA School cannot be held responsible for any changes made to third party website links that we use in our site. All links are correct and operational at time of publication. We made every attempt to link to appropriate sites, however, access to external website pages through the links we provided is at the user own risk. Please ensure you use a reliable antivirus for your computer.

The names, images and logos identifying OBA School are subject to copyright and users are not permitted to use it in any way.
Data Protection

OBA School applies the UK Data Protection Act 1998 to all of its operations.

OBA School will remove your personal records from our database within four years from the date of completing your course with us except your first, surname, date of birth, country of residence and which courses you have studied with us just in case they will be required in the future.

You have the right to ask for your personal information to be removed from our systems. You can do this by emailing or writing to us at info@obaschool.co.uk or by writing to us at the ‘Contact us’ page found on https://obaschool.co.uk/ContactUs

We only share the information within OBA School and with other organisations where such sharing is necessary for a fair and lawful purpose or where we have your consent
We will ask you for personal information, such as contact details, and will use this in order to provide you with the agreed services. OBA School will take reasonable steps to ensure the accuracy and security of any information that is held about you is kept in accordance with the law and our Privacy Policy. We will not share your data with any organisation for any purposes, unless legally necessary without explicit permission from you. Please refer to our full Policies, Conditions and Data Protection.
Enrolment
You and OBA School agree to enrolling you to one or more of our courses in accordance with the terms and conditions specified below:
1. You have read adequately through our website pages on www.obaschool.co.uk under the corresponding course page enough information and you are confident that the course you have chosen is suitable for your needs, English language skills level, abilities and circumstances.
2. You are able to enter into a legally binding contract.
3. You are over 18, or you are the parent or guardian/sponsor of the student who is under 18.
4. You are able to access your course/s online through OBA School eLearning platform.
5. You understand and agree that OBA School has not liability towards circumstances or plans the applicant may have decided to rely on based on our scholarship’s courses’ outcomes including, but not limited to further learning, exams or results. OBA School will hold no responsibility towards financial, health related or personal commitments the user has planned in relation to enrolling on our scholarship’s courses.
6. The user understands and agrees that OBA School has no responsibility towards the formal exams arrangement including fees. This is usually conducted externally by independent parties who are appointed as an approved exam centre by the examiner boards such as AQA, Pearson Edexcel or Cambridge. Student can either read through the dedicated page on our website about the exams and the awarding body on https://obaschool.com/en/BritishLearning/168/find-nearby-exam-centre or the can access directly the awarding body website to find more about their exams timetable and their approved exam centres across the UK. OBA School has no direct or indirect business relationship or partnership or any benefit with and from any exams’ centres.
7. The user understands and agrees that is considered as a private candidate. Private candidate is an individual who has studied through distance-learning, privately tutored, or by themselves. The user understands they need to introduce themselves to the exam centre as a private candidate in order for the exam centre to provide the applicant with relevant information.
8. The user understands that some of the GCSE courses such as the science subjects will include a minimum of 8 practical activities required from the students to be submitted to the exam centre and the awarding body. All approved exam centres usually facilitate sitting GCSE exams but not all of them accept submission of practical works to them, accordingly, the user has to find the closest and most convenient exam centre to them that accepts submission of practical works. The user understands and agrees that OBA School is not responsible for any logistics, arrangements or fees needed for submitting the practical works to the exam centres or the examiner-boards.
9. OBA School cannot be held responsible for any internet problems due to uploading and downloading files that may occurs. Whilst every effort is made to ensure that downloadable files are accessible and virus-free, we recommend that you install a reliable virus protection software.
10. You understand that our courses are independent study which means your performance is determined by the efforts you put towards studying, understanding, practising questions by yourself as much as possible. OBA School will deliver the learning required based on the awarding body specifications and will provide you with a number of exercises and internal exams in order for you to assess your performance.
11. If you decide to cancel your course. You will need to give notice of your cancellation in writing.
12. When you enrol on a course with us, we will do our best to make sure that you complete it even if unexpected events occur.
13. If a course tutor is no longer available OBA School reserves the right to transfer you to an alternative course tutor (where applicable) to ensure you are able to continue with your studies.
14. You must inform OBA School if your contact details change or if there is a change in your circumstances which might affect your ability to study.
15. If you have a specific learning needs, it is important that you tell us. Specific needs might include Dyslexia, Asperger’s or other needs that may affect your ability to study. Students who study from a distance may need to seek out a specialist support. Our current courses are not yet prepared to meet special needs requirements due to the nature of our online courses and due to our present available resources. Accordingly, by signing this Terms and Conditions you understand and agree that OBA School is not able to meet special needs at the present time and you expect no additional or special support towards your study with us.
16. You understand and agree that you have a period of 4 weeks from the day you receive your access credential to our eLearning platform to assess your capability and suitability with the level of difficulties of any of our courses.
17. The student understands and must follow the timetable of each of the courses which is provided in the introduction section on the course page on our eLearning platform, and agrees to; the specific time is required to meet the timetable and deadlines, new chapters will be open based on following the timetable, no exceptional access will be provided to the new chapters for any students.
18. You understand and agree that each chapter test should be submitted on time based on the deadline specified for it, unless there was a reason of not doing so supported by a written proof such as medical or a letter from employer. Failing in completing each chapter test on time will lead to terminating the student subscription/s. Reports for not completing the end of chapter exam on time will be assessed by OBA School dedicated team. Submitting your medical record or letter from employer will not automatically justify your delay. In case of accepting the reasons of not submitting the end of chapter exams, an extension will be provided for the student to complete their internal exam.
19. The user understands that OBA School will be sending frequent emails to the students asking for their review and rating our courses and service. This will help us to measure our service quality and improve accordingly, in addition, it will help us spreading brand awareness and the quality service we aim to be known for.
20. You understand that all OBA School courses and services are digital and delivered purely online electronically, hence no hard copy materials or correspondence shall be expected.
22. If you would like to quit the course or courses you are enrolled in, you are kindly requested to email us at info@obaschool.co.uk requesting terminating your enrolment.
23. If you would like us to cease emailing or contacting you by phone after you have already enrolled in any of our courses or after you have completed your course, you are kindly requested to email us at info@obaschool.co.uk requesting removing your email and contact number from our records.
21. You are responsible for ensuring you have in place all hardware and software necessary to benefit from our digital service.
You agree Not to:

Provide access to the Digital Services to any other individual or legal entity

Disrupt, interfere with or restrict the use of the services provided by OBA School

Upload or display any comments or materials through your participation through our eLearning, Live-classes or by email which are false, offensive, sexually explicit, defamatory, threatening, obscene or unlawful or which infringe intellectual property rights

Probe, scan or test the vulnerability of the Digital Service or attempt to circumvent or hack any user authentication or security controls in respect of the Digital Service

Disassemble, reverse engineer, decompile, copy, duplicate, modify or adapt any digital materials or other code or scripts forming part of our digital service or attempt to transmit to or via the any information that contains a virus, worm, Trojan horse or other harmful or disruptive component

Change, modify, delete, interfere with or misuse any files or other data created, owned or provided by OBA School or any third party provided as part of our digital service
Course Delivery
OBA School will ensure that each of its courses is delivered in respect of all material/s as described on our website on www.obaschool.co.uk However, OBA School shall be entitled to make variations to the content and delivery of any of its courses where these variations do not alter the course/s.
You understand that live classes or real-time classes are not part of the scholarships courses, however, OBA School can decide on the necessity of running live-classes based on the needs, this can be assessed solely at OBA School discretion. We have prepared adequate amount of tutorial videos and revising and practice materials for you which we tested with our students who passed their exams successfully.
Transferring to Another Course
If you wish to transfer to a different course after you have begun the course specified in your registration application because you believe that the level of the course you have begun is not appropriate for you, please contact OBA School by email and explain the reason. If we agree that the level of the course you have begun is not appropriate for you, OBA School will use reasonable efforts to transfer you to a different course (subject to availability).
Your Obligations
You must:

At all times behave with honesty, integrity and show courtesy, consideration and respect to others when participating on the same course/s you are enrolled at OBA School

Prepare for OBA School courses as reasonably required by OBA School

Access online all sessions and other activities such as homework, coursework, assignments, end of chapter tests which form part of OBA School courses and participate fully in a group work when required (subject to your absence for medical or other agreed reasons)

Respect the confidentiality of all information that you acquire during the course of your participation in OBA School courses.
OBA School reserves the right to refuse admission, deny you access to your course/s if your behaviour is considered disruptive, likely to cause damage, nuisance or offence, is in breach of our online attendance and access rules. This can lead to immediate termination of your subscription. OBA School may on occasion have to conduct security searches to ensure the safety and security, and you hereby consent to this. The unauthorised recording or any form of online duplication of our courses’ materials are prohibited and will lead to financial compensation and legal case against the breaching party.
Your Commitment
1. Work submitted will be your own. OBA School will take action against any student who passes off the work of others as their own. Where plagiarism is found we will terminate the student subscription immediately without any prior notice.
2. If your course includes assessment you must follow the procedures laid down in your course materials regarding deadlines, word length and format. You must also keep hard copies of all the work you have produced.
3. Although we provide for each course in our eLearning platform the course specifications issued by the awarding body, it is essential that you download the specification for your chosen course from the awarding body website directly. It is your responsibility to check the specification in the awarding body website regularly for updates, although we will do our utmost to provide you with the updates that will be brought up to our notice.
4. Your enrolment application should contain your current contact email and telephone number. OBA School cannot be responsible if spam filters prevent you from receiving our essential information hence you are advised to frequently check your Junk or Spam folder for any redirected email from us.
Our Commitment and Rules
At OBA School you will be taught all the specifications released by the awarding body which you need to pass successfully your exams, provided you have performed well. We will provide you with the adequate support throughout your course with tutorials, homework, assignments, tutor feedback and past papers practise. We pledge to providing a highest quality, responsive, efficient and transparent service to all our students.
8. We reserve the right to terminate your enrolment, or suspend your access, where you are in breach of our terms, conditions, policies, rules and online etiquette.
9. Behaviour that is considered rude or offensive will result in termination of your enrolment.
10. We reserve the right to refuse to accept, post, display or transmit any content in our sole discretion as well as the right to remove content or other materials from our site.
Disclaimer
OBA School cannot accept responsibility and expressly excludes liability for any loss or damage to your property that occurs whilst you are attending online our courses. Moreover, OBA School shall under no circumstances be liable to you, whether in contract, tort, breach of statutory duty or otherwise, for any loss of profit, loss of business, pure economic loss, or any indirect or consequential loss arising under or in connection with the Terms and Conditions.
Subject to a proven case by the British law, the maximum liability of OBA School under or in connection with these Terms and Conditions, whether in contract, tort, negligence, breach of statutory duty or otherwise, shall not exceed an amount equal to the fees paid or payable for the course or courses you have subscribed in with us.
OBA School does not guarantee the truthfulness of the content, or any other communications posted by users nor does it endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.
Whilst every effort is made to ensure that the content of our eLearning platform is entirely correct, sometimes- due to various reasons such as third party erroneous information that we may have used, human error, etc.- OBA School website and our eLearning platform may contain inaccuracies or errors.
We will use reasonable endeavours to our digital service available at the date and time agreed on your subscriptions. However, owing to the nature of the internet, OBA School does not and cannot warrant or guarantee that your use of our digital service will be uninterrupted or error-free. We are not responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of data over communications networks and facilities, including the internet, and you acknowledge that the Digital Service may be subject to limitations, delays and other problems inherent in the use of such communications facilities.
Your Acknowledgement and Signature
By agreeing to this Terms and Conditions you are confirming that all the information you provided in your registration application you submitted to us are true and correct and that you are over 18 years old by the time you have submitted it to us. Providing us with incorrect information leads to terminating your subscriptions. If you feel there have been some incorrect information in your application, please write to us at info@obaschool.co.uk prior to signing this Terms and Conditions document.
You have read thoroughly and understood the current Terms and Conditions Agreement and the Privacy Policy published on our website on https://obaschool.co.uk/privacy . This includes your understanding of the duration of any of our scholarships as 12 months uninterrupted.
As the Digital Service will be provided through a third-party web browser (such as Internet Explorer, Chrome and Firefox), you should also read the applicable terms of use and privacy policy as these will apply to your use of that web browser.
We may update or/and change our Terms and Conditions at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made. Your continued use and access to our site after changes are posted means you agree to be legally bound by these terms as updated or amended.
